Plan Your Mediation Presentation

Preparing your mediation presentation ensures that you have everything organized appropriately and in readily available. Proper preparation goes hand in hand with resolving the conflict quickly and successfully for all interested parties, saving both time and money for the clients involved in the dispute.
- Know not only the pertinent facts, names, dates, damages, evidence, but also the adversary and what may motivate him or her to settle.
- Prepare a summary or brief for the mediator (even if not requested). It is often effective to send a copy of the summary to the opposing counsel with a copy for the insurance adjuster, if applicable. You may want to include a confidential section in the mediator’s copy with information that the mediator can use to help you settle.
- Consider effective visual aids and the use of expert witness reports to support your position and show the opposing party how their case will appear when put up against your presentation.
- Be prepared to address any open issues, e.g. insurance coverage.
